Terms of Service

These Terms of Service ("Terms") govern your use of the SafetyKit application ("the App") provided by NerdLabs ("we," "us," or "our"). By installing or using SafetyKit, you agree to these Terms.

1. Service Description

SafetyKit is a Shopify application, embedded in the Shopify admin, that lets a merchant record the product-safety information associated with the EU General Product Safety Regulation (GPSR) — the manufacturer, the EU Responsible Person, safety warnings, and product identifiers — as shop-wide defaults and per-product details, saves that information to the merchant's Shopify products, and shows a coverage report of which products are complete.

2. Account and Eligibility

• You must have an active Shopify store to use SafetyKit.
• You must have the authority to grant SafetyKit access to your Shopify store.
• You are responsible for the GPSR information you and your staff enter, including its accuracy and completeness.
• You are responsible for the security of your Shopify account and for who on your staff can access the App.

3. Pricing and Billing

• SafetyKit offers a Free tier, free forever: shop-wide GPSR defaults for your whole catalog, the coverage report, and up to 25 product-specific overrides.
• The Pro tier is $9.99/month, billed through Shopify's billing system, and adds unlimited product-specific overrides and priority support.
• A 7-day free trial applies to your first paid subscription.
• You may change or cancel your plan at any time through Shopify.
• We reserve the right to change pricing with 30 days' notice.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or extract source code from the App
• Use automated systems to scrape or extract data from the App beyond normal use
• Resell, sublicense, or redistribute access to the App
• Interfere with or disrupt the App's infrastructure

5. Data and Privacy

Your use of SafetyKit is also governed by our Privacy Policy. By using the App, you consent to the collection and use of data as described therein. SafetyKit stores no customer (buyer) personal data.

You retain ownership of all your store data and the GPSR information you enter. We claim no ownership rights over your data.

6. Third-Party Services

SafetyKit runs on Shopify's platform and APIs. Your use of the App is also subject to the Shopify Terms of Service. We are not responsible for the availability, accuracy, or policies of third-party services.

7. Accuracy of Information

SafetyKit saves and displays the information you provide. While we strive for reliability:

• The coverage report reflects whether the fields SafetyKit tracks are filled in; it is not a legal assessment of your products.
• How and where GPSR information appears on your storefront depends on your theme and store setup.
• You are solely responsible for the content of your product listings and for meeting your legal obligations.

8. Limitation of Liability

To the maximum extent permitted by law:

• SafetyKit is provided "as is" without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.
• We are not liable for fines, penalties, product withdrawals, lost sales, or other business losses arising from the use of, or reliance on, the App.

9. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We will make reasonable efforts to notify you of planned downtime.

10. Termination

• You may terminate your use at any time by uninstalling the App from your Shopify store.
• We may suspend or terminate your access if you violate these Terms.
• Upon termination, your access tokens are deleted immediately and the data held by the App will be deleted within 30 days per our Privacy Policy.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance. We will notify you of material changes via the App or email.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through good-faith negotiation first, then binding arbitration if necessary.
